Savida Terms of Service

1. Acceptance of Terms

By accessing or using Savida ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

Savida is a personal finance management application that helps you track expenses, manage budgets, set financial goals, and monitor your financial accounts. The App may connect to third-party financial institutions through Plaid Inc. to provide account aggregation services. Premium features include an AI-powered financial coach that provides personalized weekly insights.

3. User Registration and Account Security

You must register for an account to use certain features of the App. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately if you discover any unauthorized use of your account
• Be responsible for all activities that occur under your account

Age requirements vary by jurisdiction. You must be at least 13 years old (16 in the EU/UK) to create an account.

4. Financial Account Connections

When you link financial accounts through Plaid:

• You authorize us to access your financial account information through Plaid
• You acknowledge that Plaid's Terms of Service and Privacy Policy also apply
• You understand that we do not store your banking credentials
• You can disconnect linked accounts at any time through the App settings
• We are not responsible for any fees charged by your financial institution

5. User Conduct and Responsibilities

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App
• Interfere with or disrupt the App or servers
• Upload or transmit viruses or malicious code
• Use the App to violate any applicable laws or regulations
• Share your account credentials with others
• Use automated systems or software to extract data from the App

6. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

8. Group Features and Shared Expenses

When using group expense features:

• You are responsible for expenses you create or approve
• Settlement amounts are calculated by the App but should be verified by all parties
• We are not responsible for disputes between group members
• Group owners have administrative rights and can remove members
• Deleted groups cannot be recovered

The AI Financial Coach is a premium feature that provides weekly personalized financial insights:

• Weekly check-ins delivered every Monday with analysis of your financial data
• Optional Sunday prompts allow you to ask specific questions
• THE AI COACH PROVIDES EDUCATIONAL CONTENT ONLY - NOT FINANCIAL ADVICE
• We are not registered investment advisors, financial planners, or tax professionals
• Always consult qualified professionals before making financial decisions
• AI insights are generated based on your transaction data and spending patterns
• You can customize the coach personality/tone in your settings
• Conversation history is retained to provide contextual insights
• You can opt out of the AI coach feature at any time

10. Fees and Payments

Savida offers both free and premium features:

• We will notify you of any fees before you incur them
• Subscription fees will be billed in advance on a recurring basis
• You can cancel subscriptions at any time through the App
• Refunds will be handled according to our refund policy
• We reserve the right to change fees with 30 days notice

11. In-App Purchases and Consumption Data

If we offer in-app purchases or subscriptions:

• You consent to our sharing of data regarding your usage and consumption of purchased content with Apple
• This data sharing is part of our efforts to resolve refund requests
• Information may include details about how you have accessed and interacted with purchased content
• The purpose is to help Apple make informed decisions regarding refund requests
• Data sharing is done in compliance with Apple's policies and only as necessary

All content, features, and functionality of the App are owned by Savida and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

13. Disclaimers and Limitations of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We disclaim all warranties, express or implied
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed $100 or the amount you paid us in the past 12 months
• We are not responsible for third-party services or content
• We do not guarantee uninterrupted or error-free service

Nothing in these Terms shall limit any rights you have under the laws of your jurisdiction that cannot be lawfully excluded or waived. In particular, if you are a consumer in the EU, you may have certain statutory warranties and remedies that are not disclaimed here.

14. Indemnification

You agree to indemnify and hold harmless Savida, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the App or violation of these Terms.

15. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately. You may also delete your account at any time through the App settings.

16. SMS Communications & Consent

If you provide a mobile phone number or use Savida's SMS features, you acknowledge and agree to receive transactional and informational text messages from Savida.

• Message frequency varies based on your usage of invitations, security alerts, and account activity notifications
• Message and data rates may apply from your carrier
• You can opt out at any time by replying STOP to any Savida message or by contacting [email protected]
• Reply HELP for additional assistance, or email [email protected]
• Consent to receive SMS messages is not a condition of using Savida or any paid services
• Ensure any invitees whose phone numbers you provide have consented to receive related messages from you and Savida
